JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-10-2018 The petitioner seeks regular bail in connection with Harnaut P.S. Case No. 229 of 2018, registered for offences punishable under Sections 406, 379/34 of the Indian Penal Code. Allegation as per F.I.R. that one Mantu booked the vehicle of the informant for his friend, who has to go to Biharsharif, on which, the informant sent the vehicle along with a driver, who took the friend of said Mantu Yadav to Biharsharif and thereafter, to another places but later on it was informed by the said driver that the vehicle has been taken away by the said friend of Mantu Yadav with the help of others and when the informant went to enquiry about the matter Mantu Yadav abused him.

Patna High Court Cr.Misc. No.63616 of 2018 (2) dt.25-10-2018 It has been submitted on behalf of the petitioner that he is not named in the F.I.R., his name has transpired in this case on the confession of co-accused and except that there is nothing against the petitioner. Further, he has no criminal antecedent and has been in judicial custody since 18.08.2018.

Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, this application is disposed of with direction to the court below to verify the criminal antecedent of the petitioner and if it is found that the petitioner has no criminal antecedent, the court below shall release the petitioner on bail to his own satisfaction in connection with Harnaut P.S. Case No. 229 of 2018 on furnishing bail bonds of Rs. 25,000 ( Rs. Twenty Five Thousand) with two sureties of the like amount with condition that he will cooperate in disposal of trial.
