BADAR ORAL ORDER 29-03-2023 This is an application for modification of the condition of order dated 14.10.2020 passed by the coordinate Bench of this Court in Cr.Misc. No. 25845 of 2020, arising out of Pipra P.S. Case No.426 of 2019, granting anticipatory bail to the applicant subject to deposit of Rs. 5,00,000/- in cash in the court below.

Heard both sides.

The learned counsel for the applicant submits that the applicant is not having any capacity to deposit the amount of rupees five lacs and imposing such onerous condition makes the relief granted by this Court futile.

Having considered the submissions so advanced and keeping in mind the willingness on the part of the applicant to

No.9552 of 2021(6) dt.29-03-2023 2/2 deposit an amount of Rs. 1,00,000/- before the learned trial court, accepting the statement so made by the learned counsel for the applicant, the application for modification is allowed. In lieu of the condition of depositing an amount of Rs. 5,00,000/- in cash in the court below, the applicant is permitted to deposit an amount of Rs.1,00,000/- in the court below within a period of four weeks from today. Rest part of the order dated 14.10.2020 is kept intact.
