Mr.APP ====================================================== CORAM: HONOURABLE MR. JUSTICE ASHUTOSH KUMAR ORAL ORDER 22-02-2022 Heard Mr. Ramakant Yadav, learned Advocate for the petitioner and Mr. Rajendra Prasad Nat, learned APP for the State.

The petitioner seeks bail in anticipation of his arrest in connection with Dawath P. S. Case No. 165 of 2019 (G. R. No. 1576 of 2019), instituted for the offences under Section 414 of the Indian Penal Code.

From the house of one Rama Yadav, two stolen motor-cycles were recovered. Aforesaid Rama Yadav has stated before the police that he had purchased the aforesaid motor-cycles from the petitioner.

The learned Advocate for the petitioner submits

Patna High Court CR. MISC. No.11160 of 2021(2) dt.22-02-2022 2/3 that the accusation is absolutely false. The petitioner does not possess any motor-cycle nor has he sold any vehicle to anybody much less to aforesaid Rama Yadav.

The petitioner was earlier made an accused in a case of similar nature but at that time, he was a juvenile. He further submits that any prosecution during the juvenility of a person is not stigmatic.

Apart from this, it has been submitted that there is no other material to connect the petitioner with the offence. Regard being had to the afore-stated facts, the petitioner, above-named, is directed to be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt / production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. - I, Bikramganj (Rohtas), in connection with Dawath P. S. Case No. 165 of 2019 (G. R. No. 1576 of 2019), subject to the conditions as laid down under Section 438 (2) Cr.P.C.
