There was demand of Rangdari from Mobile No.
9592036939 over Mobile No. 8092856942 belonging to the informant.
It is evident from the case diary (paragraph-15) that instead of tracing out the holder of Mobile No. 9592036939, the Investigating Officer traced out another Mobile No. 7274809200 as well as 7079145004 and further identified one Dhiraj Sahani to be the holder. It is further evident that one Santosh Sahani, friend of Dhiraj Sahani who happens to be an employee of the informant was apprehended and during course of his inculpatory extra judicial confessional statement, he had named Dhiraj Sahani, Kamal Rai and Bablu Bind (petitioner). To justify the same, the
Patna High Court Cr.Misc. No.53305 of 2016 (3) dt.23-02-2017 Investigating Officer got inculpatory extra judicial confessional statement of petitioner also.
Petitioner has got clean antecedent and is under custody since 15.09.2016.
Accordingly, petitioner, Bablu Bind is directed to be released on bail on furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Munger in Kotwali PS Case No. 251/2016. (Aditya Kumar Trivedi, J) perwez U T
