The petitioners seek bail in connection with Bagha P.S.Case No. 385 of 2017 registered under Section 395 of the Indian penal Code.

Learned counsel for the petitioners submits that petitioners are not named in the written report. There is no recovery of any incriminating article from their possession. No TIP has been held. He further submits that name of these petitioners have come merely on suspicion during the investigation, as mentioned in the impugned order. Petitioners are in custody since 06.07.2018.

Considering the aforesaid fact and circumstances, the

Patna High Court Cr.Misc. No.64157 of 2018(2) dt.26-10-2018 2/2 prayer of bail of the petitioners is allowed. The petitioners, abovenamed, are directed to be released on bail upon furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned ACJM-I, Bagha West Champaran in connection with Bagha P.S. Case No. 385 of 2017 with condition that both the bailors shall be the close relatives of the petitioners.
