====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-02-2022 Heard learned counsel for the parties through video conferencing.

The petitioner seeks bail in Bachhwara P.S. Case No. 40 of 2021, registered for the offence under Sections 302, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

Petitioner is not named in the F.I.R. Name of the petitioner has transpired during course of investigation in the confessional statement of co-accused Sushil Chaudhary, who has already been granted bail by this Court, vide order dated 28.01.2022 passed in Cr. Misc. No. 50392 of 2021. Save & except confessional statement and the fact that petitioner is friend of co-accused Sushil Chaudhary, there is no other material against this petitioner to show his complicity in the aforesaid crime. Petitioner is in custody since 27.03.2021.

Learned A.P.P. for the State has opposed the bail petition.

Considering the aforesaid facts and circumstances, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai / concerned court in connection with Bachhwara P.S. Case No. 40 of 2021.
