JUSTICE SUDHIR SINGH ORAL ORDER 24-11-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 302, 120B and 34 of the Indian Penal Code and 47 of the Arms Act.

Allegation is that informant's son was murdered by some accused persons and name of petitioner has come on the basis of suspicion.

It has been submitted on behalf of petitioner that he has falsely been implicated in the present case. He is in custody since 16.7.2016. Chargesheet has been submitted against petitioner. No allegation of tampering of witnesses is alleged against petitioner. Petitioner has been made accused merely on the basis of suspicion. There is no eye witness to the alleged occurrence nor there is any substantive evidence to suggest his implication in the present case. On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) with two sureties of the like

Patna High Court Cr.Misc. No.50632 of 2016 (2) dt.24-11-2016 2/2 amount each to the satisfaction of learned Judicial Magistrate Ist Class, Munger , in connection with Dharhara P.S. Case no. 49 of 2016.
