JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 27-07-2015 Heard learned counsel for petitioner and learned Additional Public Prosecutor for the State. The petitioner apprehends his arrest in connection with Assaon P.S. Case No. 67 of 2014 which was initially registered under Section-307 & other minor sections of the Indian Penal Code but after 11 days of the alleged occurrence, Section-302 of the Indian Penal Code was added on account of death of the injured, Achhelal Yadav.

According to prosecution case itself, it was coaccused, Yogesh Yadav who gave Gadansi blow to deceased Achhelal Yadav and so far as petitioner is concerned; it is only stated that she assaulted the informant

Patna High Court Cr.Misc. No.29013 of 2015 (2) dt.27-07-2015 2/2 with Labda. The informant sustained simple injury which is Annexure-2 to this petition.

Accordingly, it is ordered that let the petitioner named above, in the event of his arrest or surrender within four weeks from the date of receipt/production of copy of order in the court below, be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Assaon P.S. Case No. 67 of 2014 to the satisfaction of Chief Judicial Magistrate, Siwan subject to conditions as laid down u/S 438(2) of the Cr. P.C.
