JUSTICE SUDHIR SINGH ORAL ORDER 16-12-2016 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted under Sections 414, 406, 420 and 34 of the Indian Penal Code. Allegation against petitioners is that they used to deal in fake currency note.
It has been submitted on behalf of petitioners that they are in custody since 16.9.2016. Chargesheet has been submitted against petitioners. Petitioners have got no criminal antecedent. No allegation of tampering of witnesses is alleged against petitioners. Petitioners have been made accused due to mistake of fact. Two notes of Rs.500/- denomination are said to have been recovered, same are not counterfeit notes. There is no complaint in respect to petitioners for causing any wrongful gain or wrongful loss to any person.
On behalf of the State, it is submitted that petitioners are
Patna High Court Cr.Misc. No.53472 of 2016 (2) dt.16-12-2016 2/2 named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Motihari, in connection with Dumariaghat P.S. Case no. 96 of 2016.
