The petitioner seeks regular bail in connection with Pachrukhi P.S.Case No.172 of 2018 registered for offences punishable under Sections 272, 273, 308, 34 of the Indian Penal Code and Section 30(a) of Bihar Prohibition and Excise Act, 2016.
Allegation against the petitioner is about recovery of 23 lrs. of liquor form his possession. It further appears that the he is accused in similar type of two other cases. Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case and also in the earlier cases, he is in custody for about four months. Heard learned A.P.P. also.
Having heard both sides and in view of the
Patna High Court Cr.Misc. No.65884 of 2018(2) dt.26-11-2018 2/2 fact that the petitioner has criminal antecedent, I am not inclined to grant bail to the petitioner, as such this application is disposed of with direction to the learned trial court to verify the fact that the charges have been framed or not and if charge has already been framed, he shall be released on bail by the learned trial court to his own satisfaction.
