This is an application for grant of regular bail for offences punishable under Sections 272, 273 and 290 of the Indian Penal Code and Section 47, 49, 50, 51 and 53 of Excise Act. It has been submitted on behalf of the petitioner that the only allegation against the petitioner is of recovery of 10 litres of spirit and petitioner has no criminal antecedent and has been languishing in judicial custody since 09.07.2016. Heard learned A.P.P. also.

Considering the facts and circumstances of the case, nature of offence and period of custody, this application is allowed. Let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two
