The petitioner seeks bail in Jhajha P.S. Case No. 36/2014, registered for the offences punishable under Sections 302, 120B, 379, 386, 387 and 34 of the Indian Penal Code and Section 27 of the Arms Act.

The informant of this case is wife of the deceased. She has stated in her fardbeyan that her husband departed from house taking Rs. 30,000/- for collecting dues amount from Rajesh Yadav. At the time of departure three FIR named accused followed him and subsequently he was murdered in the Jungle. Learned counsel for the petitioner has submitted that this petitioner has been added in this case merely on suspicion. Other co-accused Jagarnath Yadav, having similar allegation, has

Patna High Court Cr.Misc. No.658 of 2017 (2) dt.11-01-2017 2/2 been allowed bail in Cr. Misc. No. 42454/2016. The case of this petitioner stands on similar footing.

Learned Additional P.P. opposed the submission but he concedes that the case of the petitioner stands on similar footing. Considering the facts aforesaid, the petitioner above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Jamui in connection with Jhajha P.S. Case No. 36/2014.
