JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-11-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 379, 411, 420, 120B of the Indian Penal Code, Sections 3, 4, 5 of Bihar Minors and Minerals (Prevention of Illegal Mining, Transportation and Storage) Act and Sections 33, 41, 42 of the Indian Forest Act. Petitioner is in jail custody since 02.08.2018 on the allegation that he was caught carrying stone chips. Para 3 of the petition reveals that the petitioner does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above
