JUSTICE SUDHIR SINGH ORAL ORDER 24-07-2015 The petitioner is apprehending his arrest in Tarapur P.S. Case No.82/13 for the offence under Sections 411/413/414 of the I.P.C., Section 7 of the E.C.Act and 3⁄4 of Blackmarketing Act. Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The prosecution case, in brief, is that there is accusation against the accused persons of hording kerosene oil and diesel in his shop and house which has been seized by the informant.

It has been submitted on behalf of the petitioner that petitioner's name has come in this case in course of investigation and no recovery of any essential commodity has been made from possession of the petitioner. The petitioner has no criminal

On behalf of the State it has been submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of his arrest or surrender before the court below within six months from today be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Munger, in Tarapur P.S. Case No.82/13 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
