The petitioner seeks bail in Barauni Rail P.S. Case No. 62/2015, registered under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Dr. Amrendra Kumar Singh, learned counsel for the petitioner, submits that the prayer for bail of the petitioner was earlier rejected vide order dated 06.09.2016 passed in Cr. Misc. No. 35847/2016 but the petitioner again filed this bail petition only because Khiran Singh, another co-accused, has already been enlarged on bail vide order dated 04.10.2016 passed in Cr. Misc. No. 43876/2016. It is submitted that the case of the petitioner stands on similar footing but it appears that only three months ago the prayer for bail of the petitioner was rejected. Considering the facts aforesaid, I am not inclined to

Patna High Court Cr.Misc. No.46683 of 2016 (4) dt.16-01-2017 2/2 consider the prayer for bail of the petitioner only after three months. The prayer for bail of the petitioner in Barauni Rail P.S. Case No. 62 of 2015 is rejected again.
