JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-12-2016 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Sections 304B, 201, 34 of the Indian Penal Code.

Petitioners happen to be parents in law of the deceased and the written report of informant goes to show that it was husband of the deceased, who demanded motorcycle in dowry. Moreover, petitioners are in jail custody since 28.06.2016 and the report of learned court below goes to show that case of the petitioners had been committed to the court of Sessions in their absence. It also appears from the report of learned Additional

Patna High Court Cr.Misc. No.46996 of 2016 (3) dt.09-12-2016 2/2 Sessions Judge that almost all the material witnesses, except the investigating officer and doctor, have already been examined. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of 2nd Additional Sessions Judge, Darbhanga in connection with Sessions Trial No. 240 of 2013 arising out of Manigachhi P.S. Case No. 96 of 2008, subject to condition that petitioner no. 1, namely, Nago Mandal @ Nagina Mandal shall attend the trial court on each and every date in person for the period of six months or till conclusion of his trial whichever is earlier and if he fails to do so on two consecutive dates without any genuine cause, the learned trial court shall be at liberty to cancel the bail bonds of the petitioner no. 1.
