The petitioner is in judicial custody in connection with Sessions Trial No.164 of 2021 arising out of Musrigharari P.S. Case No.84/2020 instituted under Sections 302, 307, 326, 341, 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

According to the prosecution case, the informant alleged that accused persons stopped the construction work of the road and demanded extortion which was protested by his son. This had infuriated him.

On the date of occurrence, the accused persons including the petitioner herein came and made indiscriminate firing as a result whereof while Arvind Kumar Rai and Shankar

Patna High Court CR. MISC. No.62044 of 2021(3) dt.18-05-2022 2/2 Rai were injured, his son died on the spot. The informant and the other witnesses have specifically named this petitioner as one of the person who had resorted to indiscriminate firing killing his son.

Earlier, a co-ordinate Bench of this Court was pleased to dismiss the bail application on 04.03.2021 vide Cr. Misc. No.37001 of 2020.

Nothing new has been brought forward for a review of the case in hand. A report was called for from the learned court below which has since been received and according to this, the charges were framed on 04.08.2021, the first witness was examined on 26.08.2021 and since then altogether seven witnesses have been examined. It has further been stated that the next date fixed for evidence is 17.05.2022.

Considering the aforesaid, fact this Court is not inclined to grant any relief to the petitioner and the bail application is hereby rejected.

The Trial court is directed to conclude the Trial at an earliest without any unnecessary adjournment. (Rajiv Roy, J) Prakash Narayan /- U T
