JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is not named in the first information report but in course of investigation, police doubted the role of wife of deceased Ashok Kumar and on query, she confessed her guilt. Subsequently, co-accused Jitendra Kumar was arrested and he too made his confessional statement. The aforesaid co-accused Jitendra Kumar disclosed the name of petitioner. It appears that the dagger, which is said to be used in the alleged crime, was recovered on the basis of the confessional statement of co-accused Jitendra Kumar. So far as the petitioner is concerned, except the confessional statement, there is nothing against him. Petitioner is in jail custody since 5.8.2016 and the investigation against him has

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Danapur, Patna in connection with Danapur P.S.Case No. 313 of 2016.
