Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State. The petitioner is seeking regular bail in connection with Chapra (Town) P.S. Case No. 678 of 2019, registered for the offences punishable under Sections 394, 307, 120(B) of the Indian Penal Code and Section 27 of the Arms Act. As per allegation, three accused persons committed robbery on the informant and his friend and in course of the same fired shot at the informant's friend. Two of them, the petitioner and co-accused Tej Bahadur Patel were apprehended at the spot, whereas two of the accused persons were managed

The learned counsel for the petitioner amongst inter alia has submitted that the case of the petitioner is on similar footing to that of co-accused Tej Bahadur Patel, who has been granted bail by a Co-ordinate Bench of this Court, in Criminal Miscellaneous No. 22206 of 2021. The petitioner is under custody since 12.11.2019.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-IV, Saran Chapra in connection with Chapra (Town) P.S. Case No. 678 of 2019, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offence, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance

Office shall ensure that all defects are removed by the petitioner within the stipulated time mentioned hereinabove, failing which, the matter shall be brought to the notice of this Court.
