====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 18-11-2022 Heard learned counsel for the petitioner and the State. Petitioner apprehends arrest in a case registered for the offences punishable under Sections 30(a) of the Bihar Prohibition and Excise Act, 2016.
As per prosecution case, 20 litres country made liquor has been recovered near the house of the petitioner. Learned Counsel for the petitioner submits that the petitioner has falsely been implicated in this case. Nothing has been recovered from the conscious possession of the petitioner and he is in no way connected with the aforesaid recovery. Petitioner has got no criminal antecedent.
Considering the aforesaid facts and circumstances, let the above named petitioner in the event of his arrest/surrender before the court below within a period of thirty days from the
Patna High Court CR. MISC. No.53221 of 2022(2) dt.18-11-2022 2/2 date of receipt/production of copy of this order, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Exclusive Special Judge, Excise, Court No. II, Siwan in Raghunathpur P. S. Case No. 160 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
