JUSTICE SUDHIR SINGH ORAL ORDER 24-07-2015 The petitioner apprehend his arrest in C.R.Case No.62/14 corresponding to T.R.No.2773/14 for the offences under Sections 498(A), 406/34 of the I.P.C. and Section 4 of the D.P.Act.
Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. The prosecution case, in brief, is that the marriage of the complainant took place on 24.2.2013 with the petitioner. After some time the accused persons including the petitioner used to ask for she-buffalo as dowry from the complainant and on nonfulfillment of the same they used to assault and torture. Eventually, the complainant was ousted from her matrimonial

On behalf of the petitioner it has been submitted that he is ready to keep the complainant with full honour and dignity but the same is not acceptable to her.The petitioner is ready to give the complainant an amount of Rs.1200/- per month in the court below which shall be released in favour of the complainant. On behalf of the State it has been submitted that the petitioner has been named in the F.I.R. who is husband of the complainant.
Considering the aforesaid facts and circumstances, petitioner is directed to deposit Rs.1200/- per month in the court below which shall be released in favour of the petitioner and on his doing so, let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of S.D.J.M., Jhanjharpur, Madhubani, in C.R.No.62 of 2014 / Rr.No.2773 of 2014 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
