2. The petitioners seek pre-arrest bail in connection with Sandesh P.S. Case No. 64 of 2024 registered for the offence(s) punishable under Sections 379,411,414 and 120B of the Indian Penal Code; Section 192,194 of the Motor Vehicle Act and Section 15 of Environment (Protection) Act.
3. As per the allegation made in the FIR, a tractor was seized allegedly carrying sand on a trailer without having registration number or any valid challan issued by the Mining Department.
4. Learned counsel appearing on behalf of the
Patna High Court CR. MISC. No.55858 of 2024(2) dt.31-08-2024 2/2 petitioners submitted that allegation against the petitioners under Sections 192 and 194 of Motor Vehicles Act, 1988 and under Section 15 of Environment Protection Act, 1986 are compoundable and petitioners seek that he will compound the offence and produce the receipt in the said regard before the learned District Court. Petitioner has clean antecedent.
5. Learned APP for the State vehemently opposed the prayer for grant of pre-arrest bail.
6. Having considered the rival submission made on behalf of the parties, as well as, the fact that petitioners are willing to compound the offence and produce the receipt in the said regard before the learned District Court, the petitioners, if so advised, may surrender before the learned District Court and seek regular bail. In that case, the learned District Court is directed to consider the bail application of the petitioners on the same day and pass a reasoned order.
7. The present petition stands disposed of.
