The petitioner seeks bail in Araria (R.S.) P.S. Case No. 202/2018, instituted for the offence under Section 379 of the Indian Penal Code.
It is alleged in the written report that a motorcycle bearing registration no. BR 38K 4479 was stolen, which belongs to the informant. During course of investigation, the police recovered a motorcycle bearing registration no. BR 11B 2080 from possession of this petitioner and made this petitioner accused in the instant case stating that stolen motorcycle has been recovered from possession of this petitioner but its registration number has been tampered by the petitioner.
Learned counsel for the petitioner has submitted
Patna High Court Cr.Misc. No.64091 of 2018 (2) dt.25-10-2018 2/2 that no T.I.P. of the aforesaid recovered motorcycle has been held in this case. Petitioner is in custody since 09.06.2018. Considering the aforesaid fact and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Araria (R.S.) P.S. Case No. 202/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
