The petitioner apprehends his arrest in Forbesganj P.S. case No.287 of 2016 under Section 307 and other Sections of the Indian Penal Code.

The informant alleged that petitioner, Md. Khurshid, assaulted his daughter with Farsa on her neck with intention to kill her and other accused persons assaulted wife of the informant. The learned counsel for the petitioner submits that petitioner and the informant are of the same family, the case is compromised and the dispute between the parties is resolved and lenient view may be taken but from perusal of the injury report itself, it appears that on account of assault made by the petitioner grievous injury is caused to the daughter of the informant on her

Considering the facts aforesaid, I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.

If the petitioner surrenders in the court below, i.e., the learned Chief Judicial Magistrate, Araria in Forbesganj P.S. case No. 287 of 2016, the learned court below shall consider the prayer for regular bail of the petitioner on its own merit without being prejudiced from the order of this court.
