JUSTICE DINESH KUMAR SINGH ORAL ORDER 29-07-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 364 and 120B of the Indian Penal Code.
The accusation is of kidnapping the son of the informant. On arrival of the police, co-accused Duman Ram was apprehended on the spot with the motorcycle who disclosed the name of the petitioner and one Kabid Hussain. It is submitted by learned counsel for the petitioner that as per own statement of the informant, the petitioner was on inimical terms with the informant and if the petitioner was known to the informant then there was no occasion for the informant not naming the petitioner himself.
The aforesaid facts constitute good ground for
Patna High Court Cr.Misc. No.29282 of 2015 (2) dt.29-07-2015 2/2 consideration of prayer for regular bail.
Let the learned court below consider the prayer for regular bail of the petitioner if he surrenders within a period of six weeks in connection with Chhauradano P.S. Case No. 48 of 2015 pending in the court of learned JM, 1st Class, Raxaul at Motihari, East Champaran.
Accordingly, the application is disposed of.
