====================================================== CORAM: HONOURABLE MR. JUSTICE HARISH KUMAR ORAL ORDER 19-11-2025 Heard learned Advocate appearing on behalf of the petitioners and the learned Additional Public Prosecutor for the State.
2. The petitioners are apprehending their arrest in connection with Jagdishpur P.S. Case No. 61 of 2025, registered for the offences punishable under Sections 191(2), 115(2), 126, 109, 351(2), 352 and 303(2) of the Bharatiya Nyaya Sanhita, 2023.
3. In the morning of the fateful day all the FIR named accused persons including the petitioners brutally assaulted and abused the informant and his wife. It is specifically alleged that the petitioner no.2 assaulted the informant by means of stick

Thereafter the petitioner no.2 also assaulted the informant's wife, due to which she also sustained injury over his wrist. There is further allegation of misbehaving with the wife of the informant and snatching of valuables.
4. Learned Advocate appearing on behalf of the petitioners submitted that there is a counter version of the present case being Jagdishpur P.S. Case No. 65 of 2025 instituted against the informant and others. So far the injury which is allegedly sustained to the informant and his wife are concerned, the same does not corroborate with the injury report, inasmuch as, all the injuries have been found to be simple in nature. Learned Advocate for the petitioners also drew the attention of this Court on the point of delay in lodging of the FIR and further delay in sending the same to the concerned Court. The petitioners are persons of fair antecedent and they undertake that they will fully cooperate in the proceeding of the Court and would not indulge in such activities in future.
5. On the other hand, learned Advocate for the State vehemently opposed the pre-arrest bail application.
6. Regard being had to the submissions made on behalf of the parties and considering the factum of case and

No.54086 of 2025(3) dt.19-11-2025 3/3 counter case, coupled with the simple nature of injuries as well as fair antecedent, let the petitioners above named be released on bail, in the event of their arrest or surrender before the Court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Bhojpur, Ara in connection with Jagdishpur P.S. Case No. 61 of 2025, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023 with the further condition that one of the bailors shall be the own/close family members of the petitioners.
