====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 11-08-2021 Heard the parties in virtual Court proceeding. The petitioner is languishing in custody for the offences punishable under Sections 363, 366A, 376 of the I.P.C., Sections 4, 8, 12 of POCSO Act and Section 3(ii) (v) of SC/ST Act.
The petitioner, who is a married person, allegedly induced the minor daughter of the informant to go with him and was in physical relation with her. There is no dispute that the victim was a minor. Hence, if the victim in her statement under Section 164 Cr.P.C. states that she had gone with the petitioner voluntarily as the petitioner had promised to marry with her at Delhi that would not make any difference.

Patna High Court CR. MISC. No.8680 of 2021(3) dt.11-08-2021 2/2 was in physical relation with a minor girl. Hence, I am not inclined to enlarge the petitioner on bail. Prayer for bail is refused in connection with Chiraiya (Shikarganj) P.S. Case No. 225 of 2020 pending in the court of learned 6th Additional Sessions Judge-cum-Special Judge, POCSO, Motihari, East Champaran.
