The petitioner seeks bail in connection with Ara Town P.S. Case No. 182 of 2025 instituted for the offence under Sections 115(2), 126(2), 103(1), 109 & 61(2) of the Bharatiya Nyaya Sanhita, 2023 and Section 27 of Arms Act. 3.

The prosecution case, in brief, is that on 15.03.2025 at about 9:00 PM, while the informant was going home with companions, accused Suraj, Kailash, and Golu Thakur opened fire on them, causing bullet injuries to Shubham

Patna High Court CR. MISC. No.51013 of 2025(3) dt.15-10-2025 2/3 and his friends, leading to the death of Sikandar @ Ajay Shankar Kumar. The motive was a dispute over opposition to the accused's illegal liquor business.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 17.03.2025. Petitioner bears one criminal antecedent/s, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. There is no specific allegation against the petitioner, rather the same is against other co-accused persons. From perusal of the FIR, it appears that petitioner, allegedly, is the order giver. Charge sheet has already been submitted in this case. 6.

Learned A.P.P. for the State as also learned counsel for the informant have vehemently opposed the prayer for grant of bail to the petitioner.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner, there being no specific allegation of firing against the petitioner and charge sheet being submitted, this Court is inclined to grant bail to the petitioner.

Let the petitioner be released on bail on furnishing

Patna High Court CR. MISC. No.51013 of 2025(3) dt.15-10-2025 3/3 bail bonds of Rs. 15,000/- (Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Ara Town P.S. Case No. 182 of 2025.
