The petitioner seeks bail in a case instituted under Sections 302 and 201/34 of the Indian Penal Code. Suspicion has been raised that the petitioner along with others has killed the deceased and thrown the dead body of the deceased in a river.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 23.10.2015. The charge sheet has been submitted in the present case. The petitioner has got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioner. As per the First Information Report, suspicion has been raised against the

Patna High Court Cr.Misc. No.42253 of 2016 (2) dt.03-10-2016 2/2 petitioner. From perusal of the order of the Sessions Court, it is evident that at best offence under section 201 of the Indian Penal Code is only made out against the petitioner. The main allegation is against co-accused Karu Singh. The other co-accused has been granted bail vide Annexure-2 to the present application. On behalf of the state, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 3rd Additional Sessions Judge, Nawada, in connection with S. Tr. No. 159 of 2016/145 of 2016, arising out of Warsaliganj P.S. Case No. 266 of 2015.
