The petitioner is in judicial custody in connection with Masaurhi P.S. Case No.192 of 2015 instituted under Sections 302,201,34 of the Indian Penal Code lodged on 10.06.2015 by the informant Raj Muni Devi.

As per the prosecution story, the allegation is that the informant's daughter was married to this petitioner who used to torture her for dowry and on the fateful day, the husband informed that the lady had left the place leaving the children alone. Later, it came to notice that she was actually murdered and the dead body was thrown under a bridge, finally FIR was lodged.

Learned APP has drawn attention of this Court to the fact that the FIR is of 2015, the petitioner chose to surrender only after five years in 2020.

Patna High Court CR. MISC. No.53627 of 2023(2) dt.23-08-2023 2/2 Taking into account the fact that he being the main accused in the FIR, chose to evade arrest for five years, no relief can be granted to him, the bail application stands rejected. In view of the fact that he is in custody since December, 2020, the Trial court is directed to expedite the Trial and conclude the same preferably within a period of six months from today.
