16-12-2016 Heard Sri Vijay Kumar, learned counsel for the petitioner and Sri Raj Kishore Singh, learned Addl. Public Prosecutor.

The petitioner, who is in custody on accusation of recovery of about 1 Kg. 150 gm. of opium in Special Case No. 08 of 2016, arising out of Kishanganj P.S. Case No. 240 of 2016, registered for offence under Sections 21, 22, 23 of the Narcotic Drugs & Psychotropic Substances Act, 1985, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that seizure list was not prepared in accordance with law, whereas, learned Addl. Public Prosecutor, after examining the case diary, submits that number of witnesses have been examined, who have

Patna High Court Cr.Misc. No.41694 of 2016 (5) dt.16-12-2016 2/2 supported the prosecution case.

Keeping in view the recovery of opium as well as period of custody, which is only since 16-06-2016, the Court is not inclined to extend the privilege of bail.
