2. The petitioner apprehends his arrest for the offences alleged under Sections 379/411 of the Indian Penal Code 4/40 B.M.M.C. Rules 4/21 MM (D&R) Act 6,4, 5(a)5(c)28(a) Bihar Mining and Prevention of Illegal Transportation and Storage Act registered in connection with Muffasil P.S. Case No. 283 of 2019.

3. It is submitted that the petitioner has been falsely implicated merely because he happens to be the owner of the tractor from which the illegal sand was recovered. It is submitted that the petitioner had no knowledge about such sand being loaded nor instructed his driver to do so. The petitioner claims clean antecedents.

4. Having regard to the nature of accusations and the
