The petitioner apprehends his arrest in Forbesganj P.S. Case No. 271 of 2021, registered for the offences punishable under Sections 419, 420 and other allied sections of the Indian Penal Code and section 4/5 of the Bihar Ban of Lottery Act. Prosecution case in brief is that all the FIR accused persons are alleged to have selling lottery tickets in the house of petitioner. It is further alleged that on search, bundles of lottery tickets and cash were recovered from the house. On search of apprehended accused person, some lottery tickets, mobile and cash have been recovered from their possession. Apprehended accused persons disclosed the name of this petitioner as one of their associates.

No.63038 of 2021(2) dt.12-07-2022 2/2 It is submitted that the house in question from where recovery is alleged to have been made was let out to one apprehended co-accused Raj Kumar Mandal and without the knowledge and consent of petitioner, the accused persons were running the business of selling of lottery ticket illegally. Petitioner claims clean antecedent.

Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Forbesganj P.S. Case No. 271 of 2021, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
