The petitioner apprehends his arrest in Bahadurganj P.S. Case no 07 of 2015, registered for the offences punishable under Sections 419, 420, 467 of the Indian Penal Code. The petitioner is alleged to have defalcated Rs. 21,600/-, the amount for distribution of scholarship to different students.
From perusal of the FIR it appears that the District Programme Officer, Kishanganj made thorough enquiry and found irregularity in distribution of scholarship to different students. The petitioner is ready to deposit the entire amount alleged to have
Patna High Court Cr.Misc. No.14161 of 2015 (4) dt.25-06-2015 been defalcated, amounting Rs.21,600/- as well as on account of irregularity committed in distribution of dress material. If the petitioner deposit the aforesaid amount within two weeks, the petitioner above named in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri P.K. Jha, Judicial Magistrate, 1st Class, Kishanganj in connection with Bahadurganj P.S. Case no. 07/2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
