Petitioner seeks bail in S.Tr.No.665/17 arising out of Rosera P.S. Case No.128/17 registered for the offence under Section 392 of the I.P.C. and Section 27 of Arms Act. Allegation as per the F.I.R. is of committing robbery by some miscreants at petrol pump. Petitioner is not named in the F.I.R. but later on his name transpires on the basis of confessional statement of co-accused.
Submission on behalf of the learned counsel for the petitioner is that except confessional statement nothing has come against the petitioner. He is in custody since 30.05.2017 and other similarly situated co-accused have already been granted privilege of bail vide orders dated 28.02.2018 and 26.07.2018 passed in
Patna High Court Cr.Misc. No.64328 of 2018 (2) dt.26-10-2018 2/2 Cr.Misc.
No.12285/18 and Cr.Misc.No.44778 of respectively.
Heard the learned A.P.P. also.
Having heard both sides and in view of the facts and circumstances of the case, stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of Additional Sessions Judge, Rosera, Samastipur, in S.Tr.No.665/17 arising out of Rosera P.S. Case No.128/17 subject to the condition that bailers must be of local having sufficient properties within the jurisdiction of the court concerned.
