JUSTICE BIRENDRA KUMAR ORAL ORDER 12-04-2017 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

Petitioner is languishing in custody for the offences punishable under Sections 341, 323, 324, 302 and 504/34 of the Indian Penal Code.

This is a case of misuse of privilege of bail. The petitioner is in custody since about last one year. Submission of the petitioner is that he will fully cooperate with the trial of the case. For sometime, the record was missing in the court below. In the circumstances, no regular pairvi was done in the court below.

Considering the aforesaid facts, let petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-

Patna High Court Cr.Misc. No.708 of 2017 (5) dt.12-04-2017 (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-II, Siwan/Successor Court, in connection with Siswan P.S. Case No.88 of 1996, corresponding to Sessions Trial No.475(A)/1997, with condition that petitioner shall fully cooperate with the investigation and trial of the case, failing which the Court below shall be at liberty to take steps for cancellation of the bail bonds of the petitioner in this case.
