JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 25-06-2015 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

This is an application seeking anticipatory bail in a case registered for the offences punishable under Sections 406, 420, 468, 471, 120(B), 341 and 323/34 of the Indian Penal Code. Briefly stated, the prosecution case is that the accused persons, upon assurance of getting the informant employment in government service, induced him to pay certain amount. The said amount, so obtained by the accused persons, was misappropriated by them.

Learned counsel appearing on behalf of the petitioner has submitted that in course of time, the parties have resolved their dispute. He has referred to Annexure-3, the present application

Patna High Court Cr.Misc. No.19107 of 2015 (2) dt.25-06-2015 2/2 filed by the informant as well as the petitioner. He has further submitted that the co-accused Bechan Jha, against whom the allegations are similar, has been granted regular bail by this Court vide order dated 04.03.2015 passed in Criminal Miscellaneous No. 9461 of 2015.

In view of the submission as above, let the petitioner abovenamed, in the event of his arrest/surrender before the court below within four weeks from today, be released on bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri A.K. Pandey, learned Judicial Magistrate, Madhubani in connection with Khirhar Police Station Case No. 67 of 2014 corresponding to G.R. No. 2917 of 2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Chakradhari Sharan Singh, J.) Vats/- U T
