JUSTICE SANJAY PRIYA ORAL ORDER 05-11-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Kadam Kuan P.S. Case No. 337 of 2018 instituted for the offence under Sections 364(a), 120(b) and 34 of the Indian Penal Code.

Counsel for the petitioner submits that petitioner is not named in the written report.

In the written report it is alleged that on 16.6.2012 at 12:00 noon driver of the informant Mukesh Singh along with his associates Jamil Akhtar Subhani and 5 to 6 other persons took father of the informant namely Anil Kumar Gupta for visiting Rajgir, Mundeshwari and Deo. It is further alleged that from Mobile phone of his father, the Driver Mukesh Singh informed that 5/7 persons have captured them. They asked the informant to

Patna High Court Cr.Misc. No.65654 of 2018 (2) dt.05-11-2018 2/2 deliver Rs.50,00,000/- otherwise, the father of the informant would be killed by them. It is further alleged that Mukesh Singh and Jamil Akhtar Subhani along with their associates in conspiracy with each other have kidnapped father of the informant for ransom.

Petitioner has been arrested by the police on the basis of his name disclosed by the co-accused. The police has recorded confessional statement of the petitioner. No Test Identification Parade has been held.

Considering the aforesaid facts and circumstances of the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Patna, in connection with Kadam Kuan P.S. Case No. 337 of 2018, subject to the condition that both the bailors will be the close relatives of the petitioner.
