Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 323, 325, 379, 307, 504/34 of the Indian Penal Code. The prosecution case is that on protest being made for using spurious words against the informant, she was being assaulted with bricks and gold chain was snatched and when son of the informant Raj Kumar came to rescue then this petitioner assaulted the son of the informant. It is submitted by learned counsel for the petitioner that petitioner is agnate of the informant. He resides abroad and for fixing a flag pole on the occasion of Ram Navami festival the dispute arose when husband and brother-in-law of the informant have not supported the accusation against the
Patna High Court Cr.Misc. No.28954 of 2015 (2) dt.28-07-2015 2/2 petitioner.
It is submitted by learned senior counsel for the informant that there is specific accusation of assault against the petitioner and son of the informant received grievous injuries.
Considering the fact that accusation of assault has been levelled in the background of petty dispute and petitioner has no criminal antecedent, it is a case for consideration of prayer for regular bail, if the petitioner surrenders within a period of six weeks in connection with Makhdumpur(Tehta) P.S. Case No. 93 of 2015.
Accordingly the application is disposed off.
