JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 19-09-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor.
Petitioner, happens to be driver of a truck through which the cereal which was to be supplied by U.P. Government to the kid aged about 6 months to 3 years, free of cost was being siphoned for open sale in the market of Bihar province. Altogether 227 bags were seized. Petitioner happens to be under custody since 26.06.2016.
Considering the status of the petitioner along with period of detention petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount to the satisfaction of the Learned Additional Chief Judicial Magistrate, XIII, Gopalganj in connection with Fulwariya P.S. Case No. 71 of 2016. Because of the fact that the petitioner happens to be resident of outside of state on account thereof, the learned lower court will insist for such kind of bailor through which appearance of the petitioner should remain intact during course of trial.
