JUSTICE SATYAVRAT VERMA ORAL ORDER 21-12-2022 Heard learned counsel for the petitioners, learned counsel for the complainant and learned A.P.P. for the State. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 342, 323, 504, 506, 354, 498A, 406 and 34 of the Indian Penal Code & Sections 3/4 of the Dowry Prohibition Act.

Learned counsel for the complainant at the outset very fairly submits that the complainant now has performed her second marriage.

Learned counsel for the petitioner submits that petitioner

Patna High Court CR. MISC. No.53016 of 2022(3) dt.21-12-2022 2/2 no. 1 is the mother-in-law and petitioner no. 2 is the father-in-law and petitioner no. 3 is the brother-in-law of the complainant. It is also submitted that after marriage of the complainant with the son of petitioner no. 1 and 2, Ravi Ranjan Singh, the said Ravi Ranjan Singh committed suicide on account of differences with the informant.

Learned counsel for the petitioners next submits that since the informant has already performed her second marriage as such anticipatory bail be granted to the petitioners. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, the petitioners above-named, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Complaint Case No. 261C of 2018 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
