The petitioner apprehends his arrest in a case under Section 364 of the Indian Penal Code.

The informant, mother of Vivek Kumar, disclosed that while her son was going to take tuition, Congress Yadav, Jailor Yadav and Dinesh Yadav kidnapped her son. The petitioner is not named in the F.I.R. The victim made his statement under Section 164 of the Code of Criminal Procedure and disclosed altogether a different story that the petitioner took him on the pretext that his case shall be graver and brought him at Ara Station. It appears that it is not a case of kidnapping. From perusal of the case diary, it appears that the named accused is on inimical terms with the informant. Even the victim did not support the allegation of his kidnapping for any purpose.

No.14490 of 2015 (3) dt.25-06-2015 2/2 Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Jehanabad in Pali P.S. Case No. 21/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
