JUSTICE ASHUTOSH KUMAR ORAL ORDER 14-12-2018 The petitioner seeks bail in anticipation of his arrest in connection with Prosecution Case No. C-7-25 of 2012, dated 25.01.2012, instituted for the offences under Section 47(A) of the Bihar Prohibition and Excise Act, 2016. Around 35 litres of liquor was found in the premises of a flour mill. The petitioner is said to be the owner of the aforesaid flour mill.
The learned counsel for the petitioner has submitted that the flour mill was not being used for any commercial purposes and the premises have been used by some persons in an unauthorized manner. The petitioner did

Considering the aforestated facts and the clean antecedent of the petitioner above named, he, in the event of his arrest or surrender before the learned Court below within a period of four weeks from the date of receipt/production of a copy of the present order, is directed to be released on bail on his furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Addl. Sessions Judge-II, Banka in connection with Prosecution Report C-7-25 of 2012, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
