The petitioner apprehends his arrest in a case under Section 307 and other sections of the Indian Penal Code. The petitioner is alleged to have assaulted the informant with Farsa on his head. It is submitted that there is a counter version and the dispute arose due to land dispute. It is further submitted that of course the doctor has opined the injury found on the head of the informant to be grievous in nature but the petitioner has disputed the genuineness of the injury and the final report has not yet been submitted.
Considering the fact that the petitioner is alleged to have assaulted the informant with Farsa on his head and corresponding injury is opined to be grievous in nature, I am not inclined to enlarge the petitioner on anticipatory bail in Harsidhi
Patna High Court Cr.Misc. No.14307 of 2015 (3) dt.25-06-2015 2/2 P.S. Case No. 264/2014, corresponding to G.R. Case No. 3766/2014. Accordingly, the same is rejected. The petitioner, if so advised, may surrender in the court below and the learned court below shall consider the prayer for regular bail of the petitioner without being prejudiced from this order.
