The sole petitioner, who is in custody since 25.7.2016 has prayed for grant of bail in Madhepura (Ghailarh O.P.) P.S. Case No. 444 of 2013 registered for the offence under Section 307 and other allied sections of the Indian Penal Code. It was submitted by learned counsel for the petitioner that in land dispute in between own uncle of the petitioner and petitioner and his brother occurrence had taken place in which it was alleged that petitioner along with his brother Pradeep Yadav had assaulted the informant and others by iron rod. He submits that on similar accusation brother of the petitioner namely Pradeep

Patna High Court Cr.Misc. No.43015 of 2016 (2) dt.17-10-2016 2/2 Yadav has already been granted bail by this court. In view of the fact that one of the accused having similar accusation has already been granted bail, there is no reason to deny the prayer for bail to the petitioner. Let the petitioner Dilip Yadav be enlarged on bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand ) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Madhepura / concerned court in connection with Madhepura (Ghailarh O.P.) P.S. Case No. 444 of 2013 with condition that during the trial the petitioner shall remain physically present on each and every date. If continuously on two dates he remains absent without prior permission of the trial court his bail bond shall automatically stand cancelled. (Rakesh Kumar, J) Praful/- U T
