30-09-2016 Heard Sri Manoj Kumar, learned counsel for the petitioner and Smt. Renu Kumari, learned Addl. Public Prosecutor.
The sole petitioner, who is in custody since 20-05-2016 in Barauni Rail P.S. Case No. 41 of 2016 registered for offence under Sections 414, 404/34 of the Indian Penal Code, has prayed for grant of bail.
It was submitted by learned counsel for the petitioner that petitioner's name has come in the F.I.R. on the basis of confessional statement of two accused persons, who were apprehended by the police. He further submits that nothing was recovered from conscious possession of the petitioner. Save and except the disclosure made by co-accused, there is no material
Patna High Court Cr.Misc. No.40881 of 2016 (2) dt.30-09-2016 2/2 against the petitioner. Learned counsel for the petitioner has also placed reliance on paragraph - 3 of the petition, which shows that petitioner is having clean antecedent.
In view of submission made by learned counsel for the petitioner, particularly the fact that petitioner's name has come on confession and nothing has been recovered and petitioner is having clean antecedent, let the petitioner namely Raja Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Barauni, Begusarai in connection with Barauni Rail P.S. Case No. 41 of 2016.
