2. Petitioner apprehends arrest in connection with Autarnagar P.S. Case No. 44/2021 registered for the offences under Section 409 of the Indian Penal Code.

3. Learned counsel for the petitioners submits that the petitioner is innocent and has falsely been implicated in this case. It is further submitted that the alleged money amounting to Rs. 11,74,680/- was given to the petitioner for construction of school building by the District Programme Officer, Samagra Shiksha. The aforesaid amount of Rs. 11,74,680/- along with interest of Rs. 2,69,746/- has already been returned through cheque bearing no. 041464, as is evident from Annexure '2 series'. Considering the facts and circumstances of the case and the submissions advanced on behalf of the parties, the petitioner, above named is directed to be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of learned Judicial Magistrate 1st Class, Saran at Chapra in connection with Autarnagar P.S. Case No. 44/2021 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
