29-09-2016 Heard Sri Bijay Prakash Singh, learned counsel for the petitioner and Sri Ram Sumiran Roy, learned Addl. Public Prosecutor.

The sole petitioner, who is in custody since 19-05-2016 in Jadopur P.S. Case No. 42 of 2016 registered for offence under Section 307 of the Indian Penal Code and Sections 3/4 of the Explosive Substances Act, 1908, has prayed for grant of bail, mainly on the ground that in the F.I.R., there is no allegation as to whether petitioner attempted to kill anyone, only allegation has been made that petitioner threw a bomb, which exploded outside the window of a class-room.

Learned counsel for the petitioner, by way of referring to statement made in paragraph - 3 of the petition, submits that

Patna High Court Cr.Misc. No.40835 of 2016 (2) dt.29-09-2016 2/2 petitioner is having clean antecedent and in village politics, he has been made accused.

Keeping in view the nature of accusation as well as clean antecedent of the petitioner, let the petitioner namely Raju Sahani be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Dev Priya Kumar, learned Judicial Magistrate 1st Class, Gopalganj in connection with Jadopur P.S. Case No. 42 of 2016.
