JUSTICE SUDHIR SINGH ORAL ORDER 25-06-2015 The petitioner is apprehending his arrest in connection with Chanpatiya PS case No. 43/2015 for the offence under section 341, 354(a), 354 (b), 376/511 of the Indian Penal Code. Heard learned counsel for the petitioners and the State. The prosecution story, in brief, is that the petitioner kept his hand at the breast of the informant with bad intention and began to lift her sari but she cried and managed to flee away and saved herself.

It has been submitted on behalf of the petitioner that the petitioner has no criminal antecedent. Further it has been submitted that as per the first information report the alleged date of occurrence is 06.03.2015 but the present case was instituted on 08.03.2015. On behalf of the State it has been submitted that the petitioners is named in the first information report. Considering the aforesaid facts, let the above named petitioner, in the event of his arrest or surrender in the court below within a period of four weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Bettiah in connection with Chanpatiya PS case No. 43/2015, subject to condition as laid down under section 438(2) of the Cr. P.C.
