JUSTICE RAKESH KUMAR ORAL ORDER 29-11-2016 Heard Sri N.K.Agrawal, learned Senior Counsel, who was assisted by Sri Amresh Kumar Sinha, learned counsel for the petitioner and Smt. Sharda Kumari, learned Addl. Public Prosecutor.

The petitioner, who is in custody only since 13.07.2016 in Laheri P.S. Case No.193/2016 registered for the offence under Section 20 of the N.D.P.S.Act, has prayed for grant of bail.

Learned Senior Counsel appearing on behalf of the petitioner submits that recovered Ganja was much lesser than the commercial quantity and the petitioner is having clean antecedent. According to learned Senior Counsel appearing on behalf of the

Patna High Court Cr.Misc. No.39088 of 2016 (3) dt.29-11-2016 2/2 petitioner, the petitioner is entitled to be enlarged on bail. However, on perusal of the material on record including the case diary, it is evident that the petitioner was indulged in selling of Ganja and from his possession, Ganja which is much more than the small quantity was recovered.

Since there is allegation that the petitioner was indulged in selling of Ganja, it is difficult for this Court to record any favourable order.

The petition stands dismissed.
